Ma quali sono i motivi di questa scelta e cosa prevedeva nello specifico il testo della costituzione?

Vediamo quindi cosa dicono di preciso questi articoli:

E' evidente che chi ha formulato la proposta di legge aveva perfettamente chiaro il suo scopo , data la ricchezza di particolari e la limitatezza del suo raggio d'azione.
Quello che invece suona strano, "calcolato", è la comparsa della legge proprio nel momento in cui alcuni tra gli esponenti più significativi del nostro governo si trovavano ad avere problemi con la giustizia. Sarà un caso?
Il fatto che non si sia considerato sufficiente uno strumento come il "legittimo impedimento" (che permette alle cariche dello stato di concordare le date di eventuali udienze con i giudici in modo da non sovrapporle con gli impegni istituzionali), è un ulteriore campanello di allarme.
Che sia davvero un modo per sfuggire alla giustizia?
S e vogliamo proprio girare il dito nella piaga, e pare il caso di farlo, le uniche due personalità che avrebbero usufruito del Lodo sono l'attuale premier Silvo Berlusconi e il presidente della Camera Gianfranco Fini, nei seguenti casi.
Berlusconi :
- processo per corruzione dell'avvocato David Mills;
- processo per diffamazione aggravata dall'uso del mezzo televisivo in merito alle relazioni tra le cosiddette Cooperative Rosse e la camorra;
- processo for the sale of television rights
Fini :
